Another Hypocritical Politician Masquerading as a ‘Judge’

We have yet another political activist usurping the bench and pretending to be a ‘judge:’

NY Judge dismisses state terrorism charges against Mangione, allows murder charge to stand

The 27-year-old Mangione purportedly shot a UnitedHealthcare executive last year on a New York City street over his anger with the country’s health insurance industry.

HERE IS THE TAKE-AWAY

1st — Killing someone because you disagree with their politics or hope to affect/influence political policy is the very definition of terrorism.  How can this judge — in good behavior — issue this ruling — unless they are not a judge, but a political activist pretending to be a judge (remember: form and function define)?

2nd — What is with the ‘judge’ ‘allowing’ the State to keep the 2nd degree (why not 1st degree ???) murder charges?  In our system of government, the elected State Attorney and his/her assistant DA’s are supposed to be responsible for deciding what the charges should be.  The Court just insures the defendant receives a fair trial.  It has no role in determining what the charges are.  In this case, the ‘judge’ seems to be inserting himself into the State Attorney General’s position in addition to the bench seat he usurped.

WHAT SHOULD BE DONE

1 — Remove the ‘judge’ for ‘bad behavior.’  It is legal and can be done — if there is political will to do so.  Judges are not immune from discipline, especially in cases like this, where they far exceed their authority.

2 — Re-instate the terrorism charges.

3 — Elevate this to first degree murder, as it was per-meditated (a necessary prerequisite to terrorism).

ANYTHING LESS THAN THIS IS ESTABLISHING A 2-TIER LEGAL SYSTEM BASED ON POLITICAL IDEOLOGY
